Eligibility
You must be at least 18 years old and able to form a binding contract to create an account, list, rent, buy, sell, or otherwise transact through Full Throttle Trader. By using FTT, you confirm that you meet these requirements.
What Full Throttle Trader Is
FTT is solely a venue and technology platform that lets independent users post and find off-road machines, trailers, and powersports gear. FTT is not a dealer, broker, auctioneer, escrow, lender, transporter, appraiser, title or inspection service, or the agent of any buyer, seller, owner, or renter. We are the parking lot, not the dealership.
No Verification
FTT does not verify ownership, condition, mileage, modifications, liens, titles, identity, or legality of any listing or user. A listing being visible is not endorsement, approval, or any guarantee by FTT.
Third-Party Listings & No Accuracy Warranty
Listings on FTT are created by third-party users. FTT is not a party to transactions between buyers, sellers, owners, or renters. We do not own, inspect, transport, finance, insure, or guarantee the listed items.
We do not warrant that listing titles, descriptions, prices, photos, specs, ownership claims, condition notes, locations, or availability are accurate. Every deal is between the people making it.
Buyer & User Due Diligence
Before you pay anyone, you are responsible for verifying ownership, title, liens, VINs or serial numbers, condition, legality, and safe payment. Inspect in person where possible, review paperwork carefully, and use payment methods that protect you.
Assumption of Risk & Release
Off-road and powersports activity — and buying, selling, renting, owning, transporting, demonstrating, inspecting, or using any machine, vehicle, trailer, equipment, or gear found through Full Throttle Trader — is inherently dangerous and can cause serious injury, death, or property damage, in addition to fraud and financial loss. You knowingly and voluntarily assume all of these risks whenever you use FTT or transact with another user, in any capacity. To the fullest extent allowed by law, you release and discharge Full Throttle Trader and its owners, operators, contractors, affiliates, and service providers from any and all liability, claims, and damages for injury, death, property damage, loss, or harm arising from any item, transaction, activity, meet-up, test, ride, or rental connected to FTT. FTT role is limited to hosting listings; it is never present at, and never supervises, any inspection, test, ride, exchange, or transaction.
Informational Content & Conditions
Anything Full Throttle Trader displays for general information — including the weather ticker, riding-area and destination guides, maps, locations, temperatures, and conditions — is provided as is, may be inaccurate, delayed, incomplete, or drawn from third-party sources, and is not a forecast, safety assurance, or recommendation. Conditions in the field change constantly and without warning. You are solely responsible for independently verifying weather, terrain, trail and area status, closures, permits, and hazards before and during any trip, and for your own safety decisions. FTT is not responsible or liable for the weather or for any natural event, terrain or environmental hazard, wildlife, flooding, storm, earthquake, fire, closure, or government or military activity, or for any injury, death, loss, or damage arising from conditions you encounter. Do not rely on FTT informational content in deciding to travel, ride, buy, sell, or rent. Full Throttle Trader offers the weather ticker, location and riding-area pages, and similar information solely as a free convenience and informational service to riders; it is not a core service of the marketplace, and we make no promise about, and accept no duty, warranty, or liability for, its accuracy or your use of it.
This applies to all information on Full Throttle Trader, not just weather — including whether any vendor, seller, event, or listing is actually present, open, available, stocked, or accurate. Vendor presence and hours, event schedules, and listing availability can change or be wrong at any time. Full Throttle Trader does not direct, send, recommend, or guarantee that you should travel anywhere, or that any person, vendor, event, or item will be there when you arrive. Any decision to travel, ride, attend, buy, sell, or rent is yours alone, made at your own risk, after your own verification.
Seller Ownership Promise
By submitting a listing, you confirm you legally own the item or have clear legal authority to sell or rent it. Do not list stolen property, financed property you cannot legally transfer, un-transferable property, or anything with unclear title or ownership.
Your Photos & Content (License)
You retain ownership of your content. By submitting content, you represent and warrant that you own it or have all rights needed to submit it, and that it does not infringe or violate anyone's rights, including copyright, trademark, privacy, or publicity rights. You grant Full Throttle Trader a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, copy, reproduce, display, distribute, transmit, adapt, crop, resize, create derivative works from, and promote your content, name, display name, likeness, and listing information to operate, market, improve, and promote FTT, the marketplace, and your listing, including on social media, email, search, and advertising channels. This license continues while your content is posted and for a commercially reasonable period afterward for backups, legal records, cached copies, fraud prevention, and prior marketing uses.
Acceptable Use & Prohibited Content
Prohibited listings include stolen property, counterfeit goods, recalled items not lawfully resold, items with removed or altered VINs or serial numbers, title-washed or salvage items misrepresented as clean, financed or liened property you cannot lawfully transfer, emissions-defeat devices or illegal modifications, unsafe equipment represented as ride-ready, weapons, regulated hazardous materials, and any item or rental offered in violation of law, permit, insurance, age, licensing, registration, land-use, or safety requirements. No fraud, misrepresentation, infringement, harassment, malware, scraping, or misleading listings. We may reject or remove content that violates these rules.
Listing photos must depict the actual item in its current condition. AI-generated, AI-manipulated, digitally altered, stock, or otherwise misleading images are prohibited. Sellers must accurately represent themselves, including whether they are acting as a private seller, dealer, or builder, and must not misrepresent vehicle history, title, liens, condition, damage, use, ownership, availability, or any other material fact. FTT may reject or remove listings, suspend accounts, and ban users for violations.
Fees & Payments
Any fee you pay Full Throttle Trader — including listing fees, rental listing subscriptions, and (where offered) vendor and advertising fees — pays only to publish, promote, or place your content on the site. All such fees are non-refundable once the listing, placement, or subscription period begins, and are not deposits, escrow, security, insurance, or payment for any transaction between users. Recurring fees, such as monthly rental subscriptions, automatically renew until you cancel, as described in our California Automatic Renewal Terms. We may reject, remove, suspend, or decline to refund any incomplete, misleading, illegal, or abusive submission or account. You authorize us to charge your payment method for the fees and terms you select at checkout.
California Automatic Renewal Terms
Rental listings are billed as recurring monthly subscriptions. When you start a rental listing subscription, you authorize Full Throttle Trader to charge your payment method the disclosed monthly amount each month until you cancel. The subscription renews automatically every month at the same rate unless changed with notice. You may cancel anytime online from your account or by emailing [email protected]; cancellation stops future monthly charges. Amounts already charged for the current period are not refunded unless required by law.
Account Security & Your Responsibility
You are responsible for your account, credentials, listings, communications, and transaction choices. Keep deals clean, verify details, and use payment methods that protect you.
Fraud & Abuse
Fraud, fake listings, stolen property, chargeback abuse, payment scams, or identity misuse may be reported to law enforcement. Reporting is at our discretion and does not create any duty to monitor, screen, or verify listings or users. Account and payment-processor records may be provided in response to lawful requests.
Admin Control / Termination
FTT may edit, reject, hide, or remove any listing, and may suspend or terminate any account at any time for safety, quality, legal risk, fraud, security, or any violation of these terms.
Voluntary Moderation; No Duty
FTT may review, moderate, edit, reject, remove, rank, promote, or hide listings, but doing so is voluntary and does not create any duty to screen listings, verify users, detect fraud, inspect equipment, confirm ownership, monitor transactions, or prevent harm. FTT review or approval of a listing means only that the listing may appear on the site; it is not a warranty, endorsement, certification, inspection, or guarantee.
DMCA / Copyright
If you believe content on FTT infringes your copyright, send a notice to [email protected] including identification of the work, the infringing URL, your contact information, a good-faith statement, a statement under penalty of perjury that you are authorized, and your signature.
We will review notices, remove infringing content where appropriate, and may terminate repeat infringers. Counter-notice process is available on request.
As-Is, No Warranty
FTT is provided "as is" and "as available." We do not guarantee the site is uninterrupted, secure, error-free, or that any listing, user, or transaction is legitimate or will work out. We disclaim all warranties to the fullest extent allowed by law.
Every transaction is at your own risk and is yours to vet. It is your responsibility — not ours — to do your own due diligence before you pay anyone: independently verify the item, its ownership, title, liens, VIN or serial numbers, condition, history, and the other person's identity and legitimacy; inspect in person whenever possible; and use payment methods that protect you. Do not rely on Full Throttle Trader to verify, vouch for, or stand behind any listing, user, or transaction.
Limitation of Liability
To the fullest extent allowed by law, Full Throttle Trader and its owner, operators, contractors, and service providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, death, loss, or damage arising from your use of the site, any listing, any content, any transaction, or any service interruption or security incident.
Where liability cannot be excluded, our total liability is limited to the greater of the fees you paid FTT in the 6 months before the claim or USD $100. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or fraud.
Service Interruptions
Outages, data incidents, maintenance, and third-party failures may happen and do not create operator liability except where the law requires otherwise.
Third-Party Links & Services
FTT may link to or rely on third-party sites and services we do not control. We are not responsible for their content, practices, or availability, and your use of them is at your own risk.
Indemnification
You agree to defend, indemnify, and hold harmless Full Throttle Trader and its owners, officers, employees, contractors, affiliates, and service providers from any claims, demands, actions, damages, losses, liabilities, settlements, penalties, fines, costs, and expenses, including reasonable attorneys fees, arising out of or relating to your use of Full Throttle Trader in any capacity — whether as a buyer, seller, renter, owner, vendor, or advertiser — including your listings, content, photos, descriptions, advertisements, vendor or promotional placements, messages, account use, sale or rental transactions, the items or services you offer or acquire, ownership or title claims, liens, taxes, insurance, payment disputes, chargebacks, personal injury, property damage, your violation of any law or these terms, infringement of any intellectual property or other right, misrepresentations, or any dispute between you and another user. FTT may control the defense of any matter subject to indemnification, and you may not settle any claim in a way that imposes obligations or liability on FTT without FTT prior written consent. This indemnity does not apply to the extent a claim is caused by FTT gross negligence or willful misconduct.
Force Majeure
FTT is not liable for any delay or failure caused by events beyond our reasonable control, including outages, infrastructure or third-party failures, natural disasters, or government actions.
Changes to the Service & These Terms
We may modify features, fees, listing structures, policies, and these terms. Material changes will be posted here with an updated date; continued use means you accept them.
Dispute Resolution & Arbitration
Most issues can be solved fast: contact [email protected] first and we will try to resolve it informally. This section covers disputes between you and Full Throttle Trader — for example, about the site, your account, these terms, or our service. If informal resolution fails, you and FTT agree that any such dispute will be resolved by binding arbitration in Orange County, California, on an individual basis, and you and FTT waive any right to participate in a class action or class-wide arbitration, to the extent permitted by law. This does not apply to disputes between users — see Disputes Between Users below.
Disputes Between Users
Full Throttle Trader is not a party to deals between buyers, sellers, owners, and renters. Any dispute between users — over a sale, a rental, payment, condition, a no-show, or anything else — is solely between those users, to be worked out directly between them under whatever laws apply to them. FTT has no obligation to mediate, arbitrate, or resolve user-to-user disputes, and you release Full Throttle Trader from any claim arising out of another user’s conduct or your transaction with them. The Orange County, California arbitration and venue terms above apply only to disputes with FTT, not to disputes between users.
Governing Law & Venue
These terms, and the relationship between you and Full Throttle Trader, are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to the arbitration section, the exclusive venue for any permitted court action between you and FTT is Orange County, California.
Severability & Entire Agreement
If any provision is unenforceable, the rest stays in effect. These terms are the entire agreement between you and FTT regarding the marketplace.
